Please provide the following information regarding the licensing of protected residential park home sites in your local authority area, and the implementation of the Fit and Proper Person (F&PP) test under the Mobile Homes (Requirement for Manager of Site to be Fit and Proper Person) (England) Regulations 2020.
1. Number of Licensed Sites The total number of protected residential park home sites licensed under the Mobile Homes Act 1983 in your local authority area as of the date of this request.
2. Enforcement Action on Licensing Breaches Since 1 July 2021, how many formal enforcement notices, improvement notices, or prosecution proceedings have been issued for breaches of park home site licence conditions?
3. Fit and Proper Person Applications Received How many F&PP applications have been received since the 2020 Regulations came into force and became law in 2021?
4. Applications Granted / Refused Of the above, how many applications have been:
4a. Approved (including any with conditions)
4b. Refused
5. Applications Granted with Conditions If any F&PP applications were granted subject to conditions, please detail what conditions were imposed?
6. Monitoring and Enforcement of F&PP Conditions What processes are in place for monitoring compliance with any conditions imposed under the F&PP regulations, and how many enforcement actions have been taken for breach of such conditions?
7. Revocations How many F&PP approvals have been revoked or withdrawn since the regulations came into force?
8. Unlicensed or Unapproved Managers Have you identified any Licenced sites being managed by individuals not on the F&PP register, and if so:
8a. How many cases?
8b. What enforcement action if any has been taken?
9. Government Guidance and Non-Statutory Recommendations When implementing the F&PP test, does the council:
9a. Follow the government’s published guidance in full?
9b. Take into account any non-statutory recommendations or best practice guidance such as consultation with residents? (Please provide details.)
10. Process for Review and Re-Application Given that the Fit and Proper Person Legislation requires Fit and Proper Persons as Site Managers to re-apply after a period of 5 years what plans do you have to ensure such re-applications are undertaken promptly when they become time expired after 2026.

9b. We don’t consult formally with residents but will consider any representations made.  
10. We propose to write to all relevant site owners several months before new applications are required to remind them of the mandatory nature of the scheme and offer any assistance required in completing the renewal documentation.
